Code of Conduct

Welcome to the Remarkist platform, which is owned and operated by Remarkist Inc (“Remarkist” “we” or “us”). Remarkist has been created to provide a safe, fun, and caring environment for fans to interact with one another over their favorite content franchises. For that reason, we have created this Code of Conduct (which is part of our Terms of Service) to govern how members of the Remarkist community interact with one another.
By using the Remarkist mobile application, or any Remarkist-branded website(s), apps, marketplaces, forums, games, networks, or publications (collectively, the "Products"), creating a Remarkist account and using the Products to post or share any kind of content, including but not limited to events, stories, collectibles, images, commentary, live audio, recorded audio, status updates, works you create, comments, messages, and additions to your content or the content of others, to access and view Remarkist content or other user content, to host live audio events within the Products, to utilize Remarkist game features, or to use, collect, redeem, craft, trade, or retain any in-app game items such as in-game currencies or digital collectibles (together with the Products, the “Services”), you’re agreeing to abide by the following Code of Conduct:
- Choose any of your public screen names and usernames on the Products carefully. Screen names that are deemed offensive may be modified or deactivated without notice. This may include names of offensive or notorious persons, controversial political figures, references to cultural tragedies, or of sensitive religious or occult meaning; names containing profanity, obscene slang, graphic anatomical references, racial, ethnic, sexist, or religious slurs; names with word combinations that produce an offensive result; names of, or references to, illicit substances or drug-related paraphernalia; names with intent or effect of harming the reputation of another; names including protocol prefixes and domain suffixes (e.g. http://. .org, .com); proper names of Remarkist staff or their titles; misspellings, phonetic, and alternative spellings of prohibited names. Variations of a deactivated screen name or username, as may be evidenced by your declarations under a new screen name that you are "really" the deactivated name, may also be deactivated and the account holder may have their account terminated. Be respectful and thoughtful towards members and Remarkist when choosing any screen names or usernames.
- Do not post inappropriate material. Don’t post anything that a reasonable person would consider libelous, defamatory, obscene, excessively violent, harmful to animals, pornographic, malicious, hateful or abusive. This includes “masking” language by using alternative characters/spelling/spacing to get around profanity filters, even if a member claims they were simply “testing” our profanity filter.
- Do not endanger the lives of children. Don’t post or promote the sexualization or solicitation of minors, or share any content verbal, written, or otherwise that endangers their well being. This includes images or conversations that feature minors in an inappropriate, sexualized, or suggestive manner. Any forms of child endangerment will be reported to the appropriate authorities.
- Do not engage in any disrespectful behavior towards others. Don’t threaten or verbally abuse other members, use defamatory language, or deliberately disrupt discussions with repetitive messages, meaningless messages or "spam."
- Do not discriminate against others. Don’t use language that abuses or discriminates on the basis of race, religion, nationality, gender, sexual preference, age, region, disability, etc. Hate speech of any kind is grounds for immediate and permanent suspension of access to all or part of the Services.
- Do not harass other members. Don’t celebrate or mock someone’s misfortune. Do not publish or distribute the private information of others (known as doxxing) or threaten to do so. Do not publish or distribute any recordings or screenshots from the Products with the deliberate goal to publicly shame or vilify another member. Do not use the Services to make any lewd propositions or unwanted communications with other members.
- Do not harass or defame Remarkist, its officers, its partners, or its associates. Don’t publicly disparage Remarkist or publish, distribute or willingly amplify any forms of libel or slander against the reputation of any of its officers, employees, partners, or associates. Do not engage in any forms of harassment towards officers, employees, partners, or associates of Remarkist including doxxing, deliberate use of abusive language, threats to the Products, its Services, or Remarkist officers, employees, partners, or associates. Do not make any unwanted attempts to contact Remarkist officers, employees, partners, or associates.
- Do not break the law. Do not promote, plan, glorify or engage in any illegal activities or otherwise make available content that would encourage or provide instructions for any illegal activity. These topics include crimes relating to drugs, drug paraphernalia, rape, solicitation of a minor, computer hacking, counterfeiting, software or content pirating, and fraud. Don’t take any action that infringes or violates other people’s rights, violates the law, or breaches any contract or legal duty you have toward anyone.
- Do not engage in forms of gambling. Do not use the Products to engage in any forms of gambling either using real-world currency or any in-game currency or collectibles. Games of chance are strictly forbidden in our Products.
- Represent yourself truthfully. Do not impersonate other persons, including fellow users of the Products, Remarkist, or any of Remarkist’s officers, employees, or associates by screen name or self-representation. Don't attempt to obtain sensitive information from other members. Don't engage another member under false pretenses or otherwise defraud another member.
- Do not spread harmful misinformation or disinformation. Don’t distribute or promote any health misinformation, misinformation aimed at defrauding the public, or misinformation aimed at influencing elections or the civic processes. Do not distribute synthetic or manipulated media intended to cause harm to individuals or institutions, interfere with elections, or infringe on an individual’s rights.
- Do not promote or engage in any forms of violent extremism. Don’t distribute or engage in conversations that promote or praise terrorism or terrorist groups. Don’t glorify violent ideologies. Members using accounts for the purpose of promoting violent extremism or any kind will be banned immediately.
- Do not try to harm, disrupt, or gain access to anyone’s computer or account. Don’t distribute software viruses, or anything else (code, video, programs, bots) designed to interfere with the proper function of any software, hardware, or equipment on the Products (whether it belongs to Remarkist or anyone else). Anyone linking to, posting, distributing or promoting hacks, modifications, viruses, or password mining websites may face legal action in addition to normal account penalties.
- Do not try to damage or disrupt Remarkist or its Services. Don’t try to interfere with the proper workings of the Services. Don’t bypass any measures we’ve put in place to secure the Services. Don’t try to damage or get unauthorized access to any system, data, password, or other information. Don’t take any action that imposes an unreasonable load on our infrastructure, or on our third-party providers. (We determine what’s reasonable.) Do not spam through repeated posts or off-topic content by word or intent.
- Do not scrape Remarkist. Don’t use any kind of software, device or method (whether it’s manual or automated) to “crawl”, “spider” or otherwise remove any content from any part of the Products or Services. Don’t make any use of the Products, content or Services that may have the effect of competing with or displacing the market for Remarkist, the Products, or the Services.
- Do not use any Remarkist Content without permission. Don’t change, translate, reproduce, or distribute any content found on the Products (the “Content” as described in the Terms of Service), without explicit consent from Remarkist, including recorded or copied conversations between members, or derivative works based on the Content..
- Do not steal Remarkist’s valuable intellectual property. Don’t take apart or reverse engineer any aspect of the Products or Services in an effort to access things like source code, underlying ideas, or algorithms.
- Do not make any commercial use of Remarkist without Remarkist’s prior written consent. Remarkist is for your personal and non-commercial use only. Don’t sell access to the Products or Services in any way. Don’t use the Products or Services for the purpose of advertising any goods or services. Don’t sell or monetize any Content which uses any Intellectual Property, including but not limited to designs, collectibles, narratives, characters, settings, events, articles, or concepts that are derivatives or likenesses of Content owned and/or controlled by Remarkist, without Remarkist’s prior written consent.
- Do not infringe on anyone’s property rights. Don’t upload, share, or stream any forms of content, either written, designed, oral, or otherwise, that infringe the copyrights, trademarks, or property rights of others, including content that uses elements of other people’s works in a way that violates their rights.
- Do not attempt to cheat or trick the Services in any way. Do not attempt to find loopholes in the Remarkist game rewards system or other Services. This includes spamming the Products or Services with meaningless content to produce rewards from the system; the use of any bots on the Products or Services; the use of multiple accounts (multi-boxing) to accumulate additional rewards.
- Do not debate or argue about the Code of Conduct or its enforcement. The Code of Conduct and Terms of Service are defined, interpreted, and enforced at Remarkist’s sole discretion. If you have questions or concerns about the Code of Conduct, Terms of Service, or other aspects of the Services, you may contact Remarkist Support via the designated support channels. Do not use the Products to publicly complain, debate, or argue about these agreements.
- Do not advertise on the Products without prior written approval by Remarkist.
- DO NOT CHEAT, STEAL OR DEFRAUD REMARKIST OR OTHER PLAYERS!
Violation of this Code of Conduct is grounds for termination of any accounts you may have with Remarkist which includes the forfeiture of all products/content associated with such accounts, including any collected in-game currency or any digital collectibles, as well as the revocation of your permission to use the Products. If you delete your account or it is terminated for any reason, the license you grant us via the Terms of Service to use, display, and distribute every Submission you have made survives, and any past Submission may remain accessible and usable indefinitely as part of the Services. Remarkist and its designated parties are the final judges of whether someone's behavior qualifies as inappropriate or disruptive.
We will make reasonable efforts to notify you by the email address associated with your account or the next time you attempt to access your account. Moderators, judges, or other Remarkist designees may issue formal warnings, by post, private message or email when a member has committed a Code of Conduct infraction. Depending on the severity of the infraction, Remarkist, at its sole discretion, may issue a warning, suspension or expulsion.
This Code of Conduct is subject to change by Remarkist at any time. Your continued use of the Products constitutes your acceptance of such change.
